And if the guy had been inside the restaurant and pulled out a gun, that would have been the restaurant's fault also? Sorry, I don't get that thought process.
Although I am wondering if any employees called 911 also. You'd sure think they would, but maybe they didn't realize what was going on?! Hmmm... maybe they would be willing to help out with some medical bills.
Selling the jerk's tiny cajones on ebay would be much more satisfying. (though yes, that's against their rules --but could we make an exception?)

I don't get the fairness or thought process of this either, but that is how homeowners and other liability policies are written. For example, I don't understand that if someone is walking on the sidewalk in front of your house (put down by the city) and falls, they can sue you. Your homeowner's policy will pay the claim. So, if this is true, then McD's probably has a similar policy that will pay for accidents or injuries on their property. I'm not sure, but it is something to check into especially since they don't have insurance and her DH needs some medical attention. McD's is already paying the premium for this type of coverage, so why not use it?

I'm not an insurance agent, so I can't say for sure, but I'd have to say that someone slipping on ice on your property, and breaking their back, might be your fault if you didn't remove all traces of ice from the sidewalk. On the other hand, what did McDonalds do, or for that matter, fail to do, that resulted in 2 of their customers to be assulted? I don't think you can sue for that.

Hi all.
Just got to work here and it's the first time in a day and a half I've had any time to try to string two thoughts together.
Dh is doing MUCH better today. He's such a stubborn mule - he still hasn't gone in. He's a big boy, and I can't make him (although God knows I tried!). I really think we had some angels on our shoulders though.
It could have been much worse. It could have been a gun. Ugh.
I talked to our lawyer and he said at this point our only real recourse would be to sue civily. Can you believe that?!! Of course once we get through the red tape of getting this guy arrested - YEP- he's STILL not been arrested- we'll start the civil suit wheels to rolling. Dh may never get a penny out of the guy - and I'm okay with that - but I'll tie him up with a judgement that won't let him buy/sell a house, buy a car..whatever.
It's so frustrating to see how the system works for this type of thing. I always though the Law & Order type thing is what would happen. Vicious attack= arrest. Apparently not

Almost same story with my brother in law exactly 10 days ago in the Philippines, in this road rage he got whacked on the head w/some bottles & a stick. He came home after a short trip to the emergency room & wouldnt spend the money for a CT etc & then dropped dead in his wife's arms two days later
We're just back from the funeral now.

The guy that started all this could be lying low, more than likely. So everyone please cut the police officers a little slack. They are doing what they can. It is just that when it is us, we want results like yesterday.
There are so many crazies running around these days. Scarey to get out amungst them. Law enforcement officers seem to get the blame and I don't really understand why. Their jobs are not easy.
I know there is good and bad officers out there. Just like in all other walks of life.
Guess it is obvious to you now that my DH is in Law enforcement. He was shot in the line of duty, 1973, Ok. Highway Patrol. I am lucky he made it. Most people don't live being shot in the stomach with a 357 magnum, hollow point load. He still has the bullet lodged in the muscle around his heart.
Now back to this thread.
Brook, I am so glad you and your DH are going to be OK. Thank God, they didn't have a gun, or this could all be so different.

I wish this were the case, but there will be NO slack from me and here's why.
After calling the responding officer ALL WEEK LONG, he called me back last night at 9:30pm. He then informed me that he's had the week off and that the papers are processing. He told me that the investigators would have the papers in 2-3 days, and then they'll get "around to tracking down the vehicle and guys". He told me that it was our fault these guys weren't caught because he had to spend so much time here with me and my dh that night. They have not even made an attempt to do so much as look up the license plate number -and that was directly from this cop's mouth.
WHAT?!!!
Dh was hardly cooperative that night - caused a big scene and whatnot - but explain to me why when there were 4 other officers here that the one couldn't leave to go find these men?!!
I was like, "Oh. I understand. Apparently there's only one officer in the city of M.G., and in your city it's okay to attack someone and beat them in the head with a wrench right before said officer goes into his days off cycle. Well, I'm glad to hear that these guys are going to be out partying tonight. Thank you. For Nothing."
In other words, this asswipe has enjoyed his time off while the guys that attacked us get to continue to do what they do.
I'm beyond disgusted. Absolutely disgusted.
Dh *did* go in for the CT and got the all clear. Thank God.
