    One woman filed a lawsuit in federal court against Applebee's because she says they served him a "drink."



    New York, NY -- Cynthia Pereles stopped keeping apple juice in her refrigerator this summer. That's when she says her son Seth, now 6, developed a definite aversion to the juice after a meal at an Applebee's in Battery Park City.

    "It was rather late, Seth is used to going to bed at 8 and it was 10, if I'm not mistaken," Pereles said. "And so he was acting up, as 5-year-olds do."

    Pereles says the waiter seemed annoyed as Seth took time to decide he wanted apple juice.

    "When the waiter brought our drinks, Seth took a sip from his kiddie cup, he said "mommy", he was like spitting and said this is so nasty," Pereles said.

    Her son took two sips before Pereles says she examined the drink.

    "Then I took a sip and I realized it was alcohol in the cup and I was just horrified," she said.

    Pereles said a manager told her the drink was a Long Island Iced Tea, just served accidentally to Seth. However, she says the drink was in a kid's cup, so she doesn't understand how such a mistake could be made.

    I grew up in my family's restaurant, and the dumb bartender that worked there when I was a kid accidently served me Strawberry Daquiri's more than once when I ordered a Strawberry slushy. My mom always checked my beverage when Mony (the ditzy bartender) was working.

      but I bet she didn't try to sue... I'm so sick of people trying to sue people...
      on the news it said he took a sip and said it tasted bad... she then said she took a sip and realized it was alcohol....

      big deal... if he just took one little sip...

      make them give me my meal free...

      but all the BS she said about him having nightmares etc... I don't believe it for a minute...

      then maybe these kids here should try to sue next time they open a carton of spoiled milk.... yeah.. it happens.... even when the dates are good...

      I know my attitude is off center from the norm... but it just makes me mad...

      maybe it was an honest mistake somehow... long island iced tea and apple juice ARE about the same color...

      he didn't DRINK it... just a sip...

      and he's probably had WAY more alcohol than that from cough medicine or something...

      I'm just sick of it all... the mistakes.. and the law suits..

          Yea, actually I think they said she was gonna try to sue for like 75,000 bucks! LOL Hey, she should be happy, the kid got an 8 dollar drink for the price of a glass of juice! That's a bargain! maybe she Applebees some money?

            Thank God that the kid wasn't so thirsty he just drank the drink down. A Long Island iced tea has enough alcohol that that child could have been hurt badly or even killed from drinking it all.
            I hope that the lady wins the law suit. Then maybe Applebees and other places will be more careful in the future.
            Personally I think the waiter did it on purpose. If the kid was annoying him, I mean come on, you have to "make" a LI Iced Tea and that takes several shots of alcohol, not just pouring apple juice from a bottle or carton. I hope they really investigate this.

              it's possible they had the LLIT made up and in a pitcher... (they don't usually made common mixed drinks by the glass... they do pitchers... unless you're sitting at the bar)

              that's why I'm saying the color mix-up.... ice tea, apple juice... looks the same...

              besides... if he WANTED the kid drunk.. he'd have given him apple juice... with a shot of grain alcohol in it... (it's basically tasteless... but 190 proof)

                one more thing..... I believe that what goes around... well you know the rest...

                I know a lady like that... LOOKING for ANY reason to sue... and has..... successfully a time or 2..... she's early 60's.....

                well now... her daughter isn't even 30... and has been diagnosed with terminal cancer....

                I just feel like sometimes like has a way of making you wish you'd done things differently somehow....

                a co-worker here slipped on a battery on the floor in wal-mart.... she's suing...

                she was hardly even bruised.... but she's naturally getting all the mri's money can buy.... (slight strain to a knee)...

                I just kinda makes me sad

                  I agree with you Peyton that some people are sue happy......like that lady who sued McDonalds and won because she was burned on hot coffee that she put between her legs- claiming she didn't know it was hot. Yeah right.
                  But in this case, someone innocent could have been hurt badly or killed because someone wasn't paying attention to what all they were doing. I wonder if the family was ever given an apology.

                    yeah.... I agree it's a little different coz he's a kid.... but liquor is an acquired taste... and while I can understand that he TASTED it.... he is FIVE.... not 5 months... so he told them it tasted bad... that's good...

                    and I'm guessing the management could have done a lot better PR job.... but what's the point? I mean.. in the old days.. they'd have gotten a few meal.. maybe a coupon for a return trip or something... but I think nowadays... they DIDN't apologize or say anything at all that might be construed by lawyers/jurors as an admission of guilt rather than an ACCIDENT....

                    it's sad that stuff is changing us in all kinds of ways...

                    you know what I mean? had the manager been really apologetic... etc. etc... they would have twisted that somehow to their advantage too......

                    they don't want an apology.. they want cash.... but I swear.. if you follow this family... somehow... some way.. it will come back to them... in spades..

                    trauma and nightmare my FOOT ..... the kid is FIVE... the taste all kinds of crap they don't like... including cough medicine etc.... that's all I'm saying... the trauma he MIGHT be having is definately cultivated by MOM imo

                      It could easily have been a genuine mistake, as explained here. A sincere apology and a couple of free coupons should be enough. Our litigious society is just going crazy. A couple I read of on a website:

                      A man trying to burgle a warehouse fell throgh the glass skylight when it failed to hold his weight and became a paraplegic. He sued (from gaol) the company he was trying to break into for damages and WON the case, for some $millions.

                      An older, overweight man had a heart attack whilst mowing the lawn on a hot day. He sued the makers of the lawnmower because IT DIDN'T HAVE A WARMING ON IT!! He won as well.

                      These were both in the USA but I've seen one's almost as silly here. It's really sad that we think someone always has to be responsible for our misfortunes. If you screw up, you've usually at least contributed to it!
