    HOUSTON - In a dramatic turnaround from her first murder trial, Andrea Yates was found not guilty by reason of insanity Wednesday in the drowning of her children in the bathtub.


    The 42-year-old woman will be committed to a state mental hospital and held until she is no longer deemed a threat. If she had been convicted of murder, she would have been sentenced to life in prison.

    Yates stared wide-eyed as the verdict was read, then bowed her head and wept quietly. Her relatives also shed tears, and the children's father, Rusty Yates, muttered, "Wow!" as he, too, cried.

    Four years ago, another jury convicted Yates of murder, rejecting claims that she was so psychotic she thought she was saving the souls of her five children by killing them. An appeals court overturned the convictions because of erroneous testimony from a prosecution witness.

    Yates' chief attorney, George Parnham, called Wednesday's verdict a "watershed for mental illness and the criminal justice system."

    Wendell Odom, another of Yates' attorneys, suggested that attitudes have changed since the first trial: "Five years ago there were a lot of people who could not get past the anger of what happened."

    Yates' 2002 conviction triggered debate over whether Texas' legal standard for mental illness was too rigid, whether the courts treated postpartum depression seriously enough, and whether a mother who killed could ever find sympathy and understanding in a tough-on-crime state like Texas.

    Yates drowned 6-month-old Mary, 2-year-old Luke, 3-year-old Paul, 5-year-old John and 7-year-old Noah in their Houston-area home in June 2001. Her attorneys said she suffered from severe postpartum psychosis and, in a delusional state, believed that Satan was inside her and that killing the youngsters would save them from ****.

    "The jury looked past what happened and looked at why it happened," Rusty Yates, who divorced his wife last year, said outside the courthouse. "Yes, she was psychotic. That's the whole truth."

    Juror Todd Frank said it was clear to him that Yates had psychosis before, during and after the drownings.

    "She needs help," Frank said. "Although she's treated, I think she's worse than she was before. I think she'll probably need treatment for the rest of her life."

    Prosecutors had maintained that Yates failed to meet the state's definition of insanity: that she was so severely mentally ill that she did not know her actions were wrong. "I'm very disappointed," prosecutor Kaylynn Williford said. "For five years, we've tried to seek justice for these children."

    I'm not answering the poll or commenting on her specific case, because I do not know enough details to say whether she was guilty or not. I will say I have someone in my family that suffers from serious mental illness, and unless you have first hand dealt with someone who is dillusional, it's very hard to understand. Mental illness is very real and can be very scary.

    However like i said i cannot say whether she did or didn't suffer from it.

    If anything at all good can/will come out of this, i would say it will hopefully bring more of an awareness of the seriousness of mental illness, and maybe bring more focus to it and help fund more treatment programs for those that need it. I know that the system here (in Canada) does not do nearly enough.

      Did she kill her children? Yes. There's no doubt about it.

      Was she temporarily insane at the time of the killings? I don't know.

          I agree with Sadie that it is a very touchy subject. I do however feel the husband should have taken some blame. They continued to have children knowing that she was still suffering from depression from the other births of her children. I believe she had the last 2 when she was still being treated for depression. I know some people have the belief that they should have as many children as God will allow but is it right to do so when it puts your health (mental and physical) in jeopardy? It all such a tragedy since the children were so innocent.

            No ..I am not going to comment on how I feel about the verdict either...being a nurse I can tell you ...I do feel strongly that we could use some serious consideration of how healthcare professionals can go about understanding and treating mental illness ..that is my issue!! and like Jen said maybe we can get some answers now??? I am so frustrated by mental health care in this country ..I am not sure what it is like in other parts of the world.... but we do not have the answers here ... beyond sad

              I'm with Megs. Did she kill her children? Yes she did.

              Was she mentally ill?--you'd have to be to be able to hold you own babies down and drown them one by one! What sane individual could do such a horrible thing over and over again? Does being mentally ill excuse her actions? Does that make it o.k. to kill your children in cold blood? How about "Guilty by Reason of Insanity"? Doesn't that make more sense?

                not matter what anyone feels about this it is a sick sad story ...one I would never ever want to see happen again ....I hate watching the news

                  Yes, Mog - she was deemed mentally ill. I guess I just can't get past one would HAVE to be mentally ill in order to do that. Right? I know, a part of me HAS to believe that. I can't help but think she needs help. And, lots of it. As for the sentence, I'm happy she's getting help. She wouldn't have had that provided in prison. So, in that respect only, I'm glad she was found, "not guilty".

                  But then again...there are people out there that aren't crazy that kill their kids. Remember the chick who drown her kids years ago? Two of them...strapped them in and let the car roll into a lake or something...all for a man? Was she crazy too? Now, I know she knew it wrong, but still - I think you have to be a bit "touched", "off" or "crazy" -use any word you like...... Although in her case, I was happy to see her go to jail. She seemed like a master manipulator!

                  Both cases were tragic - no getting around it. Those poor kids!

                    But I still think they need to change the way the verdict is worded. "not guilty by reason of insanity" doesn't make any sense to be, should be "guilty by reason of insanity" Afterall, we all know she's guilty, why give her a sentence that says she's not?

                        I, too, don't have an opinion on the guilty or not guilty verdict and whether she is or isn't mentally ill.

                        The subject of mental illness is very tough one. Even to this day, many people have an archaic view of people who suffer from mental illness. It's like those who suffer from it have some sort of contagious disease and need to be avoided. I've known people who have suffered from mental illness and they'd rather not reveal it, because of the attitude of the general, uninformed public.
